Terms and Conditions of Platform Use

Applies to all users | Version 1.1 | Education Intelligence Ltd (trading as School Surveys)

These Terms and Conditions (“Terms”) govern access to and use of the School Surveys platform. They apply to everyone who logs in to the portal, regardless of how access has been arranged — including:

  • leaders at schools or trusts that have signed a commercial contract with School Surveys;
  • staff at those schools or trusts who have been given portal access by the contract signatory;
  • leaders accessing the portal through a third-party arrangement;
  • leaders whose access is provided through ISC Research (for international schools); and
  • leaders participating in a free trial.

If your school or trust has signed a commercial contract with School Surveys, that contract governs your payment terms, scope of service, and commercial relationship. These Terms govern how you — and any colleague given access to the portal — may use the platform. By logging in for the first time, you agree to be bound by these Terms.

SECTION A — SCOPE AND PARTIES

1. Parties

1.1 These Terms apply between School Surveys (a trading name of Education Intelligence Ltd), a company registered in England & Wales (no. 10825354), whose registered office is at Freshmill Delta House, Bridge Road, Haywards Heath, RH16 1UA (“School Surveys”, “we”, “us”); and

1.2 You — the individual logging in to the platform, whether as the contract signatory or as a member of staff given access by the contract signatory (“you”, “user”). Where you are a member of staff given access by your school or trust, you are accessing the platform under the terms of the commercial contract signed by your institution, and these Terms apply to your use of the platform accordingly.

2. Commencement and Duration

2.1 These Terms become binding when you first log in to the School Surveys portal.

2.2 These Terms remain in force for the duration of your access, as determined by the arrangement applicable to you:

  • For contracted schools and trusts (and staff given access by the contract signatory): for the term of the commercial contract between your institution and School Surveys.
  • For third-party referrals: for the duration of the access arrangement between School Surveys and that third party.
  • For schools accessing via ISC Research: for the duration of the agreement between your institution and ISC Research.
  • For free trial users: for the trial period specified by School Surveys.

SECTION B — PLATFORM ACCESS AND LICENCE

3. Access Rights

3.1 School Surveys grants you a limited, non-exclusive, non-transferable licence to access and use the platform for internal educational, survey, and research purposes within your institution only.

3.2 You may not:

  • sublicense, resell, or distribute the platform or any reports;
  • reverse-engineer, decompile, or attempt to derive source code;
  • use the platform in any way that violates applicable law, data protection requirements, or third-party rights.

4. Contracted Schools: Staff Access

4.1 If your school or trust has a commercial contract with School Surveys, the contract signatory may grant other staff members access to the portal. By granting that access, the signatory confirms that those staff members will be made aware of these Terms and will use the platform in accordance with them.

4.2 School Surveys takes no responsibility for the actions of staff members given portal access by your school or trust (for example, surveys created or reports accessed). Responsibility for appropriate use of access granted to colleagues rests with the contract signatory.

4.3 All communication and correspondence from School Surveys (including reports) will be directed to the contract signatory unless School Surveys is asked in writing to communicate with others.

5. Free Trial Access

If you are accessing the platform on a free trial basis, School Surveys undertakes to:

  • provide portal access for the trial period, during which you may send your survey(s) and collect responses using the template(s) and/or questions designated in the trial;
  • provide you with a standard survey report by email;
  • provide this service at no cost to you;
  • not name your school or share your data in a form attributable to your school without your permission.

The following conditions apply to free trials:

  • No additional analysis beyond that contained in the report will be provided.
  • School Surveys does not accept responsibility for the content of responses, including non-genuine responses, names of individuals, or offensive language.
  • Access to the portal will cease after the survey closes or the trial period ends (whichever is sooner), unless you enter into a further agreement with us.

SECTION C — INTELLECTUAL PROPERTY AND REPORTS

6. Ownership

6.1 All platform content, survey questions (including TT Questions), reports, benchmarks, analytics, and templates remain the intellectual property of School Surveys (or are licensed to School Surveys, including from Teacher Tapp).

6.2 You are granted a non-exclusive, non-transferable, worldwide limited licence (without the right to sub-licence) to view, download, use, and reproduce reports and deliverables for internal use only within your school community.

7. Sharing and Attribution

7.1 Sharing of survey data and responses:

  • You may share your own staff, parent, and pupil response data publicly (e.g. in newsletters, on your school website, or on social media)
  • You may share up to three pages from any report publicly without further consent, with attribution to School Surveys. To share a whole report or more than three pages publicly, you must ask School Surveys for permission first.
  • School Surveys questions and Nationally Representative Data included in reports are confidential and must not be shared outside your school community or used for any other purpose without explicit consent from School Surveys.

7.2 For all users, “school community” means staff, parents, pupils, governors, and trust or local authority. It does not include sharing via social media or any publicly accessible website, except as expressly permitted above.

7.3 You agree not to modify or adapt report content or data in any way that misrepresents the underlying results.

8. School Surveys’ Use of Your Name and Logo

8.1 By entering into a commercial contract with School Surveys, your school or trust permits School Surveys to reference your school by name and to use your school’s logo on its website and printed materials as a user of its services. If you wish to withdraw this permission, please contact us in writing.

8.2 This clause does not apply to free trial users, third-party referrals, or ISC Research users unless separately agreed.

SECTION D — DATA AND PRIVACY

9. Privacy and Data Handling

9.1 Surveys, responses, and associated data will be processed in accordance with School Surveys’ Privacy Policy: https://schoolsurveys.com/privacy-policy.

9.2 Response data collected using School Surveys questions is anonymised. School Surveys does not release data that can identify individual respondents, except where a school includes its own open questions that invite participants to share identifiable information at their own discretion. Data sets may not be modified.

9.3 Contact or administrative data (e.g. for login, survey distribution, and support) is used only to manage your use of the platform and deliver the service.

9.4 At the conclusion of your access: all staff contact details shared with School Surveys for the purpose of distributing surveys will be erased and will not be used for any other purpose. Contact information used to manage the contract and provide customer service will be retained for a maximum of three further years.

10. Data Processing

10.1 For the purposes of data protection law, your school is the data controller in relation to your survey data. School Surveys acts as a data processor on your behalf. A full Data Processing Agreement is included in your commercial contract (where applicable).

10.2 In its capacity as data processor, School Surveys will:

  • only act on your documented instructions, unless required by law to do otherwise;
  • ensure that all personnel processing data are subject to a duty of confidence;
  • take appropriate technical and organisational measures to ensure the security of processing;
  • only engage sub-processors with your prior authorisation (a list of existing sub-processors is available on request);
  • assist you in meeting your obligations under UK GDPR, including in relation to data subject rights, breach notification, and data protection impact assessments;
  • delete or return all personal data at the end of the contract, unless retention is required by law.

10.3 School Surveys will process names, job titles, and contact details of school staff solely for the purpose of delivering the survey service and supporting liaison with your school during the engagement.

SECTION E — SUPPORT

11. Support and Communication

11.1 For customers contracted directly with School Surveys, or accessing via a UK-based third party, support is provided through standard School Surveys channels: support@schoolsurveys.com.

11.2 If your access is provided by ISC Research (for international schools), customer service and onboarding support are managed by ISC Research. Technical issues may be escalated to School Surveys where appropriate.

SECTION F — SUSPENSION AND TERMINATION

12. Suspension and Termination

12.1 School Surveys may suspend your access immediately if you materially breach these Terms (for example, misuse of data, breach of intellectual property obligations, or violation of privacy requirements).

12.2 For contracted schools and trusts: termination rights are governed by the commercial contract. This includes a 30-day right to cancel from the start date for a full refund, after which no refund is available. Either party may terminate immediately on written notice in the event of material breach or insolvency.

12.3 For free trial users: either party may terminate this agreement in writing without notice.

12.4 Your access will also terminate when your commercial contract with School Surveys or ISC Research expires or is terminated.

12.5 On termination, your access to the platform and reporting services will cease. School Surveys will handle any remaining data in accordance with clause 9.4.

SECTION G — LIABILITY AND DISCLAIMERS

13. Disclaimers

13.1 The platform is provided “as is”. School Surveys makes no guarantee of specific outcomes or results from your use of the platform or the reports.

13.2 School Surveys will provide its services with reasonable skill and care but does not guarantee any particular outcome or result.

13.3 School Surveys does not take responsibility for the content or accuracy of survey responses, including non-genuine responses, the naming of individuals, or offensive language.

14. Limitation of Liability

14.1 Neither party excludes or limits liability that cannot be excluded by law, including in relation to death, personal injury, fraud, or fraudulent misrepresentation.

14.2 Neither party shall be liable to the other for any indirect or consequential losses, including loss of profits, loss of business, loss of contracts, loss of anticipated savings, or loss of or damage to goodwill.

14.3 Subject to clauses 14.1 and 14.2, School Surveys’ aggregate liability to you shall not exceed the fees paid for platform access in the preceding 12 months (or, where the agreement has lasted less than a year, the total fees paid). For free trial users, liability is limited to £0 in monetary terms, save for claims that cannot be excluded by law.

14.4 You take full responsibility for, and indemnify School Surveys against, all costs and losses arising from your use of the services and deliverables, including any misuse of the platform or reports.

14.5 School Surveys is not liable for disputes arising under your commercial contract with ISC Research.

SECTION H — RELATIONSHIP TO THE COMMERCIAL CONTRACT

For contracted schools and trusts, a separate commercial contract governs the payment terms, scope of services, deliverables, fees, and other commercial arrangements. These Terms govern how the platform may be used by any individual who accesses it under that contract.

In the event of any conflict between the commercial contract and these Terms, the commercial contract prevails in relation to commercial matters; these Terms prevail in relation to platform use and conduct.

These Terms do not form part of the commercial contract and do not modify it. They are supplementary platform-use terms that apply to all portal users, including those who did not personally sign the commercial contract.

SECTION I — GENERAL PROVISIONS

15. Variation

15.1 School Surveys may update these Terms from time to time (for example, to reflect new features or changes in law). You will be given at least 30 days’ notice before any material changes take effect. Continued use of the platform after that period constitutes acceptance of the updated Terms.

16. Assignment

16.1 You may not assign, transfer, or sub-licence your rights under these Terms without School Surveys’ prior written consent.

16.2 School Surveys may assign its rights and obligations to any entity that is part of the same group or in which the shareholders of Education Intelligence Ltd own more than 50% of the issued share capital.

17. Third Party Rights

17.1 These Terms do not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999.

18. Waiver

18.1 A failure or delay by either party to exercise any right or remedy shall not constitute a waiver of that right or remedy. Any waiver must be given in writing.

19. Governing Law

19.1 These Terms are governed by and construed in accordance with the laws of England and Wales.

19.2 Each party submits to the exclusive jurisdiction of the courts of England and Wales.
