School Surveys – Product Terms of Use

These Terms set out the conditions under which schools and other educational institutions may access and use the School Surveys platform. By logging into the platform, you agree to comply with these Terms, which are designed to ensure the secure, fair and appropriate use of our service.

SECTION A. SCOPE OF TERMS

1. Parties

1.1 These Product Terms of Use (“Terms”) apply between:

  • School Surveys (a trading name of Education Intelligence Ltd), a company registered in England & Wales (no. 10825354) (“School Surveys”); and
  • You (the School / Educational Institution / user of the Platform) (“you,” “school”).

1.2 You may access the Platform either directly through School Surveys or through ISC Research. Your access is subject to these Terms even if your commercial contract is with ISC Research.

2. Commencement and Term

2.1 These Terms become binding when you first log in to the School Surveys portal and accept them.

2.2 These Terms continue for the duration that you maintain access under your commercial arrangement (directly with School Surveys or through ISC Research).

SECTION B. PLATFORM ACCESS, USE & LICENCE

3. Access and Use Rights

3.1 School Surveys grants you a limited, non-exclusive, non-transferable licence to access and use the Platform for internal educational, survey, and research purposes in your institution only.

3.2 You shall not:

  • sublicense, resell, or distribute the Platform or reports;
  • reverse-engineer, decompile, or derive source code;
  • use the Platform in any way that violates law, data protection, or third-party rights.

4. Intellectual Property and Reports

4.1 All content, survey questions, reports, benchmarks, analytics, and templates remain the intellectual property of School Surveys.

4.2 You may use, download, and reproduce reports for internal use.

 4.3 You may publicly share at most three pages from any survey report, with attribution to School Surveys, unless you obtain explicit written consent.

4.4 You agree not to modify or adapt report content or data in a way that misrepresents the underlying results.

SECTION C. DATA & PRIVACY

5. Privacy and Data Handling

5.1 Surveys, responses, and associated data will be processed in accordance with School Surveys’ Privacy Policy: http://schoolsurveys.com/privacy-policy/.

5.2 Response data is anonymised; School Surveys does not release data that can identify individual respondents (except where a school includes its own open-text questions with identifiable data).

5.4 Contact or administrative data (e.g. for login, communication) will be used only to manage your use of the Platform and provide support.

5.5 After your access terminates, School Surveys may delete or anonymise data in accordance with its data retention policy.

SECTION D. SUPPORT AND COMMUNICATION

6. Support and Communication

If your access to the Platform is provided by ISC Research, customer service and onboarding support are managed by ISC Research. Technical issues relating to Platform functionality may be escalated to School Surveys where appropriate. For customers contracted directly with School Surveys, support will be provided through the standard School Surveys channels.

SECTION E. SUSPENSION & TERMINATION

7. Suspension and Termination

7.1 School Surveys may suspend your access if you materially breach these Terms (e.g. misuse of data, breach of IP, or violation of privacy).

7.2 Your access may also terminate when your commercial contract with School Surveys or ISC Research ends.

7.3 Upon termination, your access to the Platform and reporting services will cease.

SECTION F. RELATIONSHIP TO OTHER AGREEMENTS

These Terms govern your use of the School Surveys platform. Where your access is provided under a separate commercial agreement with School Surveys or ISC Research, that agreement governs your payment and commercial terms. If there is any conflict between that agreement and these Terms, the commercial agreement will prevail in relation to commercial matters, and these Terms will prevail in relation to platform use.

SECTION G. LIMITATION OF LIABILITY & DISCLAIMERS

8. Disclaimers and Limits

8.1 The Platform is provided “as is.” School Surveys makes no guarantees of specific outcomes or results from your use.

8.2 School Surveys is not liable for:

  • indirect or consequential losses;
  • any loss, damage, or claims arising from your misuse of the Platform or reports;
  • disputes arising under your commercial contract with ISC Research.

 8.3 School Surveys’ aggregate liability under these Terms shall not exceed the fees you have paid for Platform access in the last 12 months (unless otherwise required by law).

SECTION H. GENERAL PROVISIONS

9. Variation

9.1 School Surveys may update these Terms (for example, to reflect new features or law changes). Notice will be provided at least 30 days before any material changes take effect.

10. Governing Law and Jurisdiction

10.1 These Terms are governed by and construed in accordance with the laws of England and Wales.

10.2 You submit to the exclusive jurisdiction of the courts of England and Wales.
